The terms that govern your use of SiteSculpture's website, services, and AI automation systems.

These Terms & Conditions ("Terms") govern your access to and use of the website, services, and AI automation tools provided by SiteSculpture ("SiteSculpture," "we," "us," or "our"), including custom website and SEO builds, advertising and funnel management, AI chat and text/callback automations, and review management services, offered primarily to construction and medical businesses ("Client," "you," or "your"). By engaging our services, visiting our website, or accessing our automation systems, you agree to be bound by these Terms.

1. Services Provided

SiteSculpture provides marketing and automation systems that may include, without limitation:

  • Custom website design, development, and local SEO optimization.
  • Paid advertising campaign management and conversion funnels.
  • AI-driven automations for chat, text messaging, missed-call recovery, appointment reminders, and review requests.
  • Reputation and review management.
  • Reporting dashboards and ongoing optimization and support.

The specific scope, deliverables, timeline, and pricing for services will be set out in a separate proposal, order form, or service agreement ("Service Agreement") between SiteSculpture and the Client, which is incorporated into these Terms by reference.

2. Client Responsibilities

  • You must provide accurate, current information necessary for us to build, launch, and operate your website, ad campaigns, and automation systems.
  • You are responsible for ensuring you have the legal right to contact leads and customers via phone, SMS, or email, and for maintaining accurate opt-in records where required.
  • You are responsible for reviewing and approving website content, ad copy, and automated messaging templates prior to launch.
  • You must comply with all applicable laws relevant to your industry (e.g., healthcare advertising and privacy regulations, construction licensing/advertising regulations).
Our AI text, chat, and callback systems are designed to contact leads who have consented to be contacted, in line with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and applicable carrier and platform messaging policies. The Client is responsible for ensuring underlying consent is properly obtained and documented for any contact list, form, or opt-in mechanism used to feed these systems. SiteSculpture is not liable for Client-supplied contact data that lacks proper consent.

3. Fees & Payment

  • Fees for services are set out in the applicable Service Agreement and may include one-time setup fees, monthly retainers, and/or ad spend passed through to advertising platforms.
  • Payments are due on the schedule specified in the Service Agreement. Late payments may result in suspension of services, including website hosting, ad campaigns, or AI automation tools.
  • Ad spend paid directly to third-party platforms (e.g., Google, Meta) is separate from SiteSculpture's service fees unless otherwise stated.

4. Term, Cancellation & Termination

  • Services are provided on the term specified in the Service Agreement (e.g., month-to-month or a minimum contract period).
  • Either party may terminate services as permitted under the applicable Service Agreement, subject to any minimum term and notice requirements.
  • Upon termination, SiteSculpture may disable AI automations, ad campaigns, and hosting associated with the Client's account, subject to any transition terms in the Service Agreement.

5. Intellectual Property

  • Unless otherwise agreed in writing, SiteSculpture retains ownership of proprietary automation workflows, templates, software, and internal tools used to deliver services.
  • Upon full payment, the Client is granted a license to use the final website, ad creative, and automation content developed specifically for the Client's business, for use in connection with that business.
  • Client-owned assets (e.g., logos, trademarks, business content, testimonials) remain the property of the Client.

6. No Guarantee of Results

While SiteSculpture uses tested strategies, SEO, advertising, and AI automation results (such as rankings, lead volume, bookings, or revenue) depend on many factors outside our control, including market conditions, competition, platform algorithm changes, and Client responsiveness. We do not guarantee specific results, rankings, or return on investment.

7. Limitation of Liability

To the maximum extent permitted by law, SiteSculpture's total liability arising out of or related to these Terms or the services shall not exceed the fees paid by the Client in the three (3) months preceding the claim. SiteSculpture shall not be liable for indirect, incidental, special, or consequential damages, including lost profits or lost business opportunities.

8. Third-Party Platforms

Our services may rely on third-party platforms (e.g., Google Ads, Meta Ads, SMS/telephony providers, CRMs, hosting providers, review platforms). SiteSculpture is not responsible for outages, policy changes, or account restrictions imposed by these third-party platforms.

9. Confidentiality

Each party agrees to keep confidential any non-public business, technical, or financial information disclosed by the other party in connection with the services, and to use such information only for purposes of fulfilling obligations under these Terms.

10. Disclaimer of Warranties

Our website, services, and automation tools are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Governing Law & Disputes

These Terms are governed by the laws of [Insert State/Jurisdiction], without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved in the courts located in [Insert Jurisdiction], unless otherwise specified in the Service Agreement.

12. Changes to These Terms
